NSW Conveyancing FAQs
Answers to common questions about conveyancing in NSW, including timelines, fees, and how we support your settlement.
Most NSW conveyancing matters take 6 to 8 weeks from contract exchange to settlement, depending on finance approval, inspections, and any special conditions. Off-the-plan purchases can take 12–36 months depending on construction.
Yes. We provide clear, upfront fixed-fee pricing for all NSW conveyancing services — residential from $1,850 + GST, commercial from $2,500 + GST, and property transfers from $1,500 + GST. No hourly rates and no surprise bills.
Absolutely. We can review contracts within 24–48 hours, explain key clauses, flag risks, and advise you before you exchange in NSW. A contract review is the most important step a buyer can take before committing to a purchase.
Yes. We handle off-the-plan conveyancing in NSW, including reviewing disclosure documents, sunset dates, plan of subdivision, strata by-laws, and Section 9A material change notices. We protect buyers from common off-the-plan developer risks.
A conveyancer is a licensed professional who manages the legal aspects of transferring property ownership. In NSW, conveyancers must hold a licence under the Conveyancers Licensing Act 2003. A conveyancer reviews contracts, conducts property searches, manages exchange of contracts, coordinates settlement, and registers the title transfer.
NSW conveyancing professional fees typically range from $1,200 to $3,500 depending on the transaction type and complexity. Elyment Conveyancing charges from $1,850 + GST for residential purchases and sales. On top of professional fees, disbursements (government search fees, PEXA fees, title registration) typically add $500–$1,200.
A licensed conveyancer in NSW specialises exclusively in property law and conveyancing, holding a specific Conveyancers Licence. A solicitor holds a broader legal practising certificate and may practise in many areas of law. For property transactions, a licensed conveyancer typically offers equal expertise at a lower cost than a general solicitor.
Standard NSW conveyancing searches include: title search, planning certificate (s10.7), sewer diagram, council rates certificate, water charges certificate, land tax clearance certificate, and strata report (for strata properties). Additional searches such as contamination searches, heritage searches, and PPSR searches may be required depending on the property.
Exchange is the point at which both parties are legally committed to the transaction. Each party signs a copy of the contract, the copies are exchanged (in person or electronically), and the buyer pays the deposit (usually 10%). In NSW, buyers of residential property have a 5 business day cooling-off period after exchange unless a Section 66W certificate is used to waive it.
In NSW, residential property buyers have a 5 business day cooling-off period starting from exchange. During this time, the buyer can rescind (cancel) the contract but must pay a 0.25% penalty of the purchase price. The cooling-off period does not apply to auction purchases or where both parties have signed a Section 66W certificate.
Yes. First home buyers in NSW are exempt from stamp duty on properties valued up to $800,000. A partial concession applies for properties between $800,000 and $1,000,000. First home buyers purchasing a new home (including off-the-plan) valued up to $600,000 may also be eligible for the $10,000 First Home Owner Grant (FHOG). We confirm your eligibility as part of your conveyancing.
Yes. Elyment Conveyancing operates remotely across all of NSW. For rural and regional transactions, we communicate by phone, email, and video call and handle all documentation electronically. Specific rural searches (such as water licences, mining tenure, and Crown Land status) are included where relevant.
